We only keep your personal data for as long as we need to in order to use it as described above in Section 6, and/or for as long as we have your permission to keep it.

The BluWave Sites are hosted in the United States and are governed by United States law. If you are using the BluWave Sites from outside the United States, please be aware that your personal data will be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. You are deemed to accept and agree to this transfer by using the BluWave Sites and submitting personal data to us.

Data security is important to BluWave, and to protect your data we have taken suitable measures to safeguard and secure personal data collected through the BluWave Sites.  BluWave also regularly evaluates and upgrades its security measures to ensure secure processing of personal data. No data transmission over the Internet can be guaranteed to be completely secure; accordingly, we cannot ensure or warrant the security of any information that you transmit to us, so you do so at your own risk.

9. Personal Data Sharing and International Transfer

For the purposes described in this Privacy Policy, we use the services of various contractors, mainly digital service providers and trusted partners. These contractors process specific categories of personal data on our behalf to help us organize events, store data, analyze and organize data, provide support services, and perform customer engagements. With each of these contractors we have contractual agreements which ensure that your personal data is protected and that the processing of personal data is limited to the minimum necessary to perform the contracted services.   • for the processing purposes described to you above, we may share your personal data with subsidiaries of BluWave (currently located in India, Ireland, Japan, the United States, the United Kingdom, and Belarus) and each such BluWave subsidiary will be under the direction of BluWave.

All the information you provide may be transferred or accessed by entities around the world. BluWave uses approved Model Contractual Clauses GDPR Model Contractual Terms  for the international transfer of personal information collected in the European Economic Area and Switzerland.

10. What Happens If Our Business Changes Hands

We may, from time to time, expand or reduce our business and this may involve the sale and/or the transfer of control of all or part of our business. Any personal data that you have provided will, where it is relevant to any part of our business that is being transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this Privacy Policy, be permitted to use that data only for the same purposes for which it was originally collected by us.

In addition to your rights set forth in Section 4, when you submit personal data via a BluWave Site, you may be given options to restrict our use of your personal data. In particular, we aim to give you strong controls on our use of your personal data for direct marketing purposes (including the ability to opt-out of receiving emails from us which you may do by unsubscribing using the links provided in our emails and at the point of providing your details).

California Civil Code Section 1798.83 permits users that are California residents to request certain information regarding our disclosure of personal information to third parties for such third parties’ direct marketing purposes. With regard to the California Consumer Privacy Act (“CCPA”) please be advised that BluWave will not sell your data to any third parties, California Law requires that we allow you to Opt-Out Of the sale of your personal information.

If you are a California Consumer you have certain rights under the CCPA: Consumers have the right to request access to personal information. They can make this request for free, twice per year.

1.Right of Access

On receiving an access request, you must provide the necessary information in a portable and easily accessible format, normally within 45 days of the request. Upon receiving your request and confirming your identity, we will disclose to you:

  • The categories of personal information the business collects about the consumer
  • The categories of sources of the consumer’s personal information
  • The business or commercial purpose for collecting or selling the consumer’s personal information
  • The categories of any third parties with whom the business shares the consumer’s personal information

2. Right to Deletion

  • Describe you request in sufficient detail to allow us to understand, verify and respond to your request.

We will only use the personal information provided with the consumer request to verify the consumer’s identity (compliant).

Colorado, Connecticut, Virginia, and Utah each provide their residents with rights to:

14. BluWave’s Use of Cookies and Web Beacons

BluWave Sites may place and access certain cookies on your computer or device. We use cookies to facilitate and improve your experience on the BluWave Sites and to provide and improve our products and services.

A cookie is a small text file that is stored in on a computer either temporarily for that session only or permanently on the hard disk (persistent cookie). Cookies provide a way for the BluWave sites to recognize you and keep track of your preferences.

BluWave uses the following cookies:

You may stop BluWave’s use of cookies at any time by configuring your browser settings.  All modern internet browsers provide the option to change cookie settings.  Such settings are most often located in the “Preferences” menu or “Options” section of your browser.

Some web browsers may transmit “do not track” signals to websites with which the web browser communicates. The BluWave Sites do not currently recognize or respond to “do not track” signals.

BluWave sites may also utilize web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) on certain pages of the Site. Web beacons are small electronic files that permit the BluWave, for example, to count users who have visited those pages and for other related website statistics.
